These terms of use are entered into by and between you and Cabhit.com Ltd. The following terms and conditions, together with any documents they expressly incorporate by reference (collectively, these “Terms of Use”), govern your access to and use of cabhit.com, including any content, functionality and services offered on or through Cabhit.com (the “Website” and the ‘Mobile App’), whether as a guest, Cabhit member, or a registered user.
1. SERVICES
Cabhit Ltd. offers information and a means to obtain transportation services offered by third party service providers or vehicle operators. The service may be requested through phone, Cabhit’s official website, or by installing the Cabhit mobile application on your smartphone. All services provided to you by the use of our Booking Channel i.e the website, the mobile app or through phone, or for booking purpose are hereinafter referred to as the “Service”.
2. OUR CONTRACTUAL RELATIONSHIP
- These Terms of Use (“Terms”) govern the access or use by any user that may be an individual or a group of individuals (for personal or business purpose) from any country in the world.
- Your access and use of the Services constitutes your concurrence to be bound by these Terms which establishes a contractual relationship between you and Cabhit. If you do not agree to these Terms, you may not access or use the Services. These terms expressly supersede prior agreements or arrangements with you. Cabhit reserves the right and accordingly may, from time to time, terminate or revise these terms or any services with respect to you, or generally cease offering or deny access to the Services or any portion thereof, at any time for any reason at its own discretion. All changes are effective immediately upon posting. Your continued use of the website and/or application following the posting of revised Terms of Use means that you accept and agree to the changes as they are binding on you.
3. USE OF WEBSITE AND/OR APPLICATION
- When you make a Booking via this website and/or application, you must provide accurate details and are responsible for any failure to do so.
- Cabhit is not responsible for the behaviour, actions or inactions of taxi/cab drivers. Any contract for the provision of cab/taxi services is between you and the cab service provider. Cabhit holds no responsibility for the contract. We only provide a platform to introduce cab service providers and passengers.
- Cabhit acts as a disclosed booking agent for the taxi, cab or minicab service provider (private taxi operator with whom you place the booking), and is not an operator in itself.
- You hereby warrant to Cabhit that you are at least sixteen years of age and legally able to make the booking. If you are less than sixteen years old, you may only use this service in conjunction or with the previous explicit authorisation of your parents/guardians.
- Your details and data relating to your use of the Website or Mobile Application will be recorded by Cabhit but your personal data shall not be disclosed to third parties other than the cab service provider or used for any purpose unrelated to the provision of the services pursuant hereto.
- Cabhit does not guarantee that it will be able to fulfill your requirements and reserves the rights to refuse any bookings which you wish to make and to cancel any bookings you have already made. We also not guarantee any refunds, in full and final settlement of any claims you might have, the fee or charges paid by you, in such cases.
4. BOOKINGS
- You agree that you will not use Cabhit for any unlawful purpose; in any way that interrupts, damages, impairs or renders Cabhit less efficient; to transfer files that contain viruses, trojans or other harmful programs; to access or attempt to access the accounts of other users or to penetrate or attempt to penetrate any security measures; to disseminate any content which is defamatory, obscene, or may have the effect of being harassing, threatening or abusive to an individual or group of individuals on the basis of religion, gender, sexual orientation, race, ethnicity, age or disability or otherwise; to advertise or promote third party or your own products or services.
- You further agree that you will refrain from doing anything which is reasonably believed to be disreputable or capable of damaging Cabhit’s reputation.
- Cabhit will endeavour to provide you via the Website (or application) with Quotes from cab service providers that are able to fulfill your taxi transfer requirement when you enter the details of the trip. The Quotes are the current special “one off” offers available from cab service providers, which are only available at the time you make the booking and may vary from time to time.
- Any booking you make may also be subjected to the Terms & Conditions of cab service provider, although where there is any conflict between the cab service provider’s Terms & Conditions and the provisions of this agreement, the provisions contained in this agreement override those in the cab service provider’s Terms & Conditions.
- You agree that it is your responsibility to ensure that your details are correct. When you make a booking, this constitutes an offer which Cabhit may or may not accept. Your booking is not confirmed until you see the express confirmation on the website and/or the application.
- If the cab service provider wishes to impose its own Terms & Conditions on you, it shall be responsible for achieving this.
- Cabhit cannot confirm the ability of the cab service provider to accommodate any particular requirement(s) and in the event that you have such particular requirement(s), you should not use this website or application but instead make alternate travel arrangements that address your particular requirement(s).
- You accept that Cabhit is acting as the agent of the cab service provider and that while Cabhit will try to assist with any complaints you may have in respect of the cab service provider’s services, any legal remedy you seek will be sought against the cab service provider, and not against Cabhit.
- Cabhit reserves the right to correct typographical errors in any elements of the information that appears on the Website and/or application including pricing mistakes. If, once you are informed of such error, you wish to withdraw your offer and do not wish to proceed with the booking, you shall be free to do so and any booking amount already paid by you will be refunded in full.
- In respect of the bookings that are to be prepaid by Card, Cabhit is entitled to collect all booking amount due for the booked Trip from you acting entirely in its own right, and settle all card costs of the booked trip in advance of making the payment due to the cab service provider for the booked trip as the cab service provider booking agent.
- You acknowledge that in the fulfillment of the booking, where the cab service provider feels it is appropriate, the cab service provider gives Cabhit the right to novate the contract for the provision of transport services between you and the cab service provider to another suitable party, to ensure the fulfillment of booking as effected via Cabhit’s website or application.
5. PAYMENT
- If booking with the ‘Pay by Card’ option, you agree to pay the fare at the time you make the booking. Cabhit does not facilitate ‘Pay by Cash’ option.
- If paying by Card, in the event that your card payment is refused by your card issuer for whatever reason, Cabhit will not be able to fulfill your booking.
- Once you have confirmed your booking on the payment screen, it cannot be generally cancelled or changed except in accordance with clause 6 of these Terms.
- Cabhit will provide you with a receipt for payment by email to the email address you register to make the booking. This will also include a link/reference for getting/downloading the VAT receipt.
- In the event that you make any deviations from the route that you entered into the Website or Mobile Application, you may be subjected to additional charges by the cab service provider in respect thereof and will make such payment directly to the cab service provider.
- Payment will not cover any extra requirements you request, such as child seats. If you do not indicate any additional luggage when booking, resulting in a larger size vehicle being required, then the cab service provider may charge you extra, which you must pay them directly. If you wish to give a tip to the cab driver, you should do so directly at your own discretion.
- Cabhit offers no warranties on payments made direct to the cab service provider with Cash or BACS.
- The booking confirmation generates a unique booking reference identification which shall be mentioned during any future communications related to the particular trip.
6. CANCELLATION OF BOOKINGS AND REFUNDS
- You have the right to cancel a booking made through the Website and/or Mobile Application.
- If you decide to cancel a booking, you must notify Cabhit by using the cancellation options available to you via the website or application.
- In the event of cancellation of a booking, up to 6 hours (unless otherwise specified on the confirmation page and your booking confirmation email) before the agreed time, you will be entitled to a refund of the fare (excluding any card costs, if paying by card). Cabhit will accept any cancellation as long as notice is provided. There will be a £5 or 10% (whichever is higher) administration / transaction charge per journey. All cancellations must be made via an email to which you will receive confirmation by us. Where the cancellation is less than 1 hours (unless otherwise specified on the confirmation page and your booking confirmation email) before the agreed time, no refund will be due to you.
- In the event that the cab service provider does not turn up at the agreed pick-up point within 15 minutes of the agreed time – or within 30 minutes if the pick-up point is an airport – and you do not use the cab service provider for the trip, you will be entitled for the full refund of the booking amount. However, in case, at your own discretion, you decide to continue with the trip where the cab service provider turns up after 15 minutes from the agreed time, you will not be entitled to any such refund, for that matter.
- In the event that you are not available at the agreed pick-up point within 15 minutes of the agreed time, it will be at the cab service provider’s discretion to treat your non-availability as a cancellation, and you will not be entitled to any refund of the fare, and any card costs that you may have paid in advance. Where the cab service provider decides to wait more than 15 minutes from the agreed time, then you may be subject to additional charges by the cab service provider in respect of any additional waiting time and/or parking charges and will make such payment directly to the cab service provider.
- For pre-paid bookings, any refunds due to where system is unable to generate bookings, if a back button in press or loss of connection where the monies in already collected from your bank should be notified to the cabhit with in 5 working days from the date the booing is made (business days being Monday to Friday). There will no refund issued if cabhit is notified after this period.
- This service considers that staff should be safe at work and should not be exposed to undue or unreasonable risk. It believes that staff must work safely, free from the threat of injury or distress from the abusive behaviour of others. It will not tolerate abuse in any shape or form and will investigate all reported or observed incidents of staff being subject to disrespectful behaviour or abuse. Driver can refused the journey in event of any abusive behaviour at the time of pick up and no refund will be issued for the journey.
7. INSURANCE
- Neither Cabhit nor the cab service provider is responsible to you for, or insured in respect of, any damage or loss that may be sustained by the goods in the course of a trip and it is your exclusive responsibility to have such goods insured in respect of such damage or loss.
8. WARRANTY AND LIMITATION OF LIABILITY
- Cabhit shall not be liable for any delays in pick-up or drop-off times or for any failure of the cab service provider to arrive at all or for any failure of the cab service provider to provide its services in accordance with your requirements or expectations.
- Cabhit shall not, in any event, be liable (whether in contract or otherwise) for any indirect loss or consequential loss or loss of revenue, howsoever arising, suffered by you in connection with any failure by the cab service provider or otherwise in connection with these terms or otherwise and if you consider that you have any claim in respect of any failure by the cab service provider, you agree to make such claim directly against the cab service provider.
- Nothing in this clause shall operate so as to exclude any rights you may have under consumer legislation or limit the cab service provider’s liability for death or personal injury arising out of its negligence.
- Any estimation about trip times and times of arrival presented by Cabhit on its public website or otherwise, are only to be taken as indicative, and are not subject to traffic and/or weather conditions and final route taken by driver. Therefore, you agree that you are responsible for setting an appropriate agreed time that allows you sufficient time to reach your destination to subsequently check-in for a flight, take a train or fulfill any other dependencies you might have.
- Cabhit may keep you informed of the status of your booking by sending you email, and/or SMS text alerts, although Cabhit does not guarantee the delivery nor the timing of these email and/or SMS text alerts, and shall not in any event be liable (whether in contract or otherwise) for any indirect loss or consequential loss or loss of revenue, howsoever arising from the omission or delay of such email and/or SMS text alerts.
9. BEHAVIOUR
- The cab service provider reserves the right within its reasonable discretion to terminate the trip, if you or your party’s conduct or behaviour is disruptive in any way and/or affects your safety or that of the driver of the vehicle. Neither Cabhit nor the cab service provider accepts liability for any extra costs incurred by you or your party as a result of the cab service provider doing so.
- Passengers are not permitted to consume alcoholic drinks onto the vehicles for the purpose of consuming them during the trip.
- The cab service provider further reserves the right to refuse carriage to any person who is thought/suspected to be under the influence of alcohol or drugs.
10. LIMITATIONS AND EXCLUSIONS
- The cab service provider shall not undertake the carriage or delivery of:
- Money, antiques, precious metals, fur, jewellery or valuable items, any goods or property (of whatsoever nature) at his sole discretion.
- any goods or property of a hazardous, dangerous, inflammable, explosive or noxious nature, or are illegal to possess under existing English Law, and/or
- any goods or property (of whatsoever nature) which may deteriorate in transit.
- The cab service provider shall have no liability whatsoever for loss or damage, however arising in relation to the clause 10.1 of this agreement.
- Without prejudice to the provisions of clause 10.1, the cab service provider shall not in any event be liable directly or indirectly for:
- consequential loss (whether for loss of profit or otherwise) and/or
- loss, damage and/or breakage to any fragile items whatsoever whether arising from the acts, omissions or negligence of the cab service provider and/or its employees and/or agents or arising otherwise howsoever.
- Without prejudice to the generality of clauses 10.1 and 10.2 in particular, the cab service provider shall not be liable for any loss and/or damage arising directly or indirectly from:
- breakdown, accident, or adverse weather conditions,
- any act or omission on the part of the Customer
- any clause, act or circumstance beyond the control of the cab service provider including, without limitation, any strike (official or not), lock-out or other form of industrial action or labour dispute, governmental regulations, legal restrictions, embargoes, fire, flood, Act of God, any consequence of riot, war, invasion, act of foreign enemy, hostilities (whether war be declared or not), civil war, acts of terrorism, rebellion, military or usurped power, confiscation, requisition or destruction of or damage to property by or upon the order of or in the name of any Government or public local authority, or other conditions amounting to force majeure).
- The provision of clauses 10.1, 10.2, 10.3, 10.4 apply to liability for loss or damage to goods or property and do not apply to liability for death or personal injury.
11. DISPUTES
- In case you have any complaint in respect of the service provided by the cab service provider, you agree to first contact the cab service provider directly (by the phone or email) to resolve the issue with the service provider within 24 hours or the agreed time.
- If you are subsequently unable to resolve your complaint with the cab service provider, you agree to notify Cabhit thereof via the form/details on the ‘Contact’ page or by email to [email protected] within 72 hours or the agreed time. In the event that you fail to do so, any claim you might otherwise have shall be invalidated.
- If Cabhit is unable to resolve any claim(s), then on the basis of the service provided by the cab operator, you and the cab operator may amicably resolve the claim(s). Cabhit shall be entitled to submit such claim(s) to the determination of an independent third party selected by Cabhit, and you agree to be bound by the decision of such third party.
- If you have a dispute with the cab service provider, Cabhit is not liable for any claims, demands and damages (actual and consequential) of any kind and nature arising out of or in any way connected with such disputes.

12. PRIVACY POLICY
Cabhit will maintain the confidentiality of personal data collected as part of booking process. This data will not be shared with third parties without your consent. Cabhit may amend this privacy policy, and will make such changes public via the website and/or application.
13. MISCELLANEOUS
- These terms shall form the entire agreement between the parties and supersede any previous agreement and (save so far as expressly preserved hereby) representations (oral or otherwise) made by either of the parties. You warrant that you have not relied on any representation made by Cabhit in entering into this agreement.
- All notices to Cabhit shall be given by you in writing to [email protected].
- All notices to you shall be given in writing to the email address you have provided as part of the details. All notices may be served by email and shall be deemed to have been given 1 hour after transmission thereof.
- These terms and your agreement with Cabhit shall be governed and construed in accordance with the English Law. You irrevocably agree for the exclusive benefit(s) of Cabhit to submit any dispute(s) hereunder to the jurisdiction of the courts of England but nothing herein shall prevent Cabhit from taking proceedings against you in any other court of competent jurisdiction.
14. LINKS FROM THE WEBSITE
- If the Website contains links to any other site(s) and resources provided by third parties, these links are provided for your convenience only. Cabhit has no control over the contents of those sites or resources, and accept no responsibility for them or for any loss or damage that may arise from your use of them. If you decide to access any of the third party websites linked to this website, you do so entirely at your own risk and subject to the terms and conditions of use for such websites.
